Draft Immigration Amendments

The Chamber appreciates the objectives of the legislation, as it seeks to provide greater control and knowledge in the realm of immigration. To this extent the Regulations are acceptable. However, the Chamber remains concerned about the issue of scarce skills work visas as we are well aware of gaps in the higher order skills requirements in the South African economy. The Chamber is anxious about the discretion given to the Minister of Home Affairs in developing the critical skills list. The Chamber is also concerned that this legislation does not place a requirement on the foreign worker or the firm to transfer these critical skills to local workers.
